The legal fights and vendor practices are not theoretical. Private companies that scraped public images to build biometric databases have faced lawsuits and settlements that show the limits of a purely market driven approach. That litigation has constrained where and how some vendors offer their tools and has given plaintiffs and regulators leverage to force changes to data practices.
Operational experience with social media and open source monitoring teaches a practical lesson. Tools that ingest bulk social content and surface alerts for law enforcement can help identify genuine threats. They also tend to reproduce customer bias, surface noisy signals, and chill lawful dissent when used without clear rules. Investigations and watchdog reporting show that social media alerting services have been applied to protests and political activity in ways that raised First Amendment and civil rights concerns.
Those facts mean the debate is not binary. Privacy is not an obstacle to security. It is a design constraint. The question for security leaders is not whether to use AI. It is how to build programs that deliver operational value while limiting abuse and legal exposure.

Narrow the mission. Define specific, auditable use cases. Do not permit blanket monitoring or exploratory data grabs. Keep scope tied to articulated, time bound threats.

Collect the minimum data needed. Favor metadata and event scoring over raw biometric or content retention when possible. Where biometric matching is necessary use enrollment by consent, role based access, and strict retention windows.

Bake in human oversight. Use human review gates on any action that affects individual liberty, access, or intervention. Preserve logs of human decisions and model outputs for audit.

Apply privacy enhancing techniques. Where models must learn from sensitive data consider federated learning, differential privacy, or on device inference to reduce centralized risk. Document tradeoffs and residual risks.

Require transparency and reporting. Publish the policies that govern surveillance AI, the legal authorities relied upon, and regular metrics on use, false positives, and disciplinary actions. Civil society and oversight bodies must be able to assess impact.

Contract and procurement safeguards. Insist vendors provide technical documentation, red team results, and access for independent audits. Do not outsource governance. Contracts must include breach and misuse clauses and termination for noncompliance.

Establish escalation and legal review. Any new capability that touches sensitive personal data should go through a legal and ethics review prior to deployment. Keep a low threshold for suspension if unintended harms appear.
Scenario planning matters. Consider a city that deploys an anomaly detection model on transit cameras to flag ‘suspicious’ behavior. The model drifts after training and begins flagging a disproportionate number of individuals from a particular neighborhood. Without retention limits and audit trails that pattern will be invisible until civil complaints or litigation. The fix is not just a better model. It is design choices that limit data collection, make outputs auditable, and require human validation prior to enforcement.
Resource allocation must follow risk. Fund governance, independent testing, red teaming, and privacy engineering early. Those capabilities are cheap insurance compared to reputation damage, litigation, or outright program shutdown when abuses surface. Teams that treat privacy as an add on will pay more in the long run.
Finally, public trust is a force multiplier for operational success. Agencies that are upfront about what they collect, why, and how they mitigate risk get better cooperation. Opacity creates resistance, court challenges, and policy backlash. If your program cannot pass a transparency test then it is a liability not an asset.
AI will make threat detection faster and broader. That is an operational advantage that agencies and private operators should not forgo. But deploying these systems without clear legal authority, privacy safeguards, and independent oversight trades short term gains for long term loss. Build defensible programs, limit data, staff governance, and be ready to stop systems when they fail the tests you set. That is the only way to have both security and privacy in practice.
